These Terms and Conditions ("Terms") govern your access to and use of the website and services provided by MAS Affect Refrigeration & Air Conditioning Ltd.("we", "us", or "our"), including viewing service descriptions, booking appointments for quotations, installations, service and maintenance, and making payments online (collectively, the "Services").
By accessing or using our website or Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility and Use of the Website
You represent and warrant that you:

Quotes, estimates, and scopes of work are subject to:

Changes requested by the customer.
We reserve the right to refuse or discontinue Services at our discretion where permitted by law.
3. Appointments, Quotes, and Scheduling

Booking an appointment does not guarantee availability or pricing.

Quoted prices are valid only for the time period specified in the written quote.

Appointment times are estimates and may be adjusted due to weather, access issues, emergencies, supply chain delays, or prior job overruns.

You are responsible for providing accurate site information and safe access to the work area.
Missed or cancelled appointments may be subject to fees, where permitted by law, if insufficient notice is provided.
4. Pricing, Payments, and Billing

All prices are in Canadian Dollars (CAD) unless otherwise stated.

Taxes, permits, crane fees, electrical work, structural work, or third-party services may be excluded unless expressly stated in writing.

Deposits may be required prior to ordering equipment or commencing work.
Online Payments
Payments made through the website are processed by third-party payment processors. We do not store full credit card details.
You authorize us to charge the payment method on file for:

Approved quotes and signed work authorizations;

Deposits, progress payments, and final balances;
-
Additional work approved verbally or in writing, where permitted by law.
Late or unpaid balances may accrue interest at the maximum rate permitted by law and may result in suspension of Services.
5. Changes, Extras, and Unforeseen Conditions
Any work not explicitly included in the written quote is considered extra work and may result in additional charges.
Unforeseen conditions may include, but are not limited to:

Existing code violations;

Unsafe or non-compliant installations;

Concealed damage;
-
Asbestos or hazardous materials;
-
Electrical or structural deficiencies.
Such conditions may require revised pricing, timelines, or scope changes.
6. Customer Responsibilities
You agree to:

Provide clear, safe, and uninterrupted access to the site;

Ensure utilities (power, gas, water) are available as required;

Secure pets, occupants, and valuables;
-
Obtain landlord or property owner consent where applicable;

Disclose known hazards or site conditions.
We are not responsible for delays or additional costs caused by failure to meet these responsibilities.
7. Warranties and Manufacturer Terms

Equipment warranties are provided by the manufacturer, not by MAS Affect, unless expressly stated in writing.

Labour warranties, if offered, are limited to the terms specified in the written agreement.

Warranty coverage may be void due to misuse, lack of maintenance, unauthorized modifications, or environmental conditions.
No other warranties, express or implied, are made except as required by law.
8. Limitation of Liability
To the fullest extent permitted by law:

MAS Affect shall not be liable for indirect, incidental, consequential, special, or punitive damages;

Our total liability for any claim arising out of or relating to the Services shall not exceed the amount paid by you for the specific Services giving rise to the claim.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
9. Indemnification
You agree to indemnify and hold harmless MAS Affect, its owners, employees, and contractors from any claims, damages, losses, or expenses arising from:

Your breach of these Terms;

Inaccurate information provided by you;

Unsafe site conditions not disclosed in advance;

Misuse of installed equipment.
10. Intellectual Property
All content on the website, including text, logos, graphics, images, and layout, is the property of MAS Affect or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, or use any content without prior written consent.
11. Third-Party Links and Tools
The website may contain links to third-party websites or tools. We are not responsible for their content, availability, or privacy practices. Use of third-party services is at your own risk.
12. Termination
We may suspend or terminate access to the website or Services at any time, without notice, for breach of these Terms or where required to protect our business, clients, or legal rights.
Termination does not relieve you of payment obligations for Services already performed or equipment ordered.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict of law principles.
You agree that any disputes shall be resolved exclusively in the courts of Alberta, Canada.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and any written quotes or service agreements, constitute the entire agreement between you and MAS Affect regarding the Services.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Services constitutes acceptance of the revised Terms.
